Acceptance of Terms

By accessing or using Opndig ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

Description of Service

Opndig provides an AI-powered recruiting platform accessible via MCP (Model Context Protocol), Slack, and API. The Service helps recruiters screen candidates, manage pipelines, and fill roles faster by:

  • Screening candidates against job requirements using AI and producing structured assessments
  • Organizing candidates into pipelines with stage tracking
  • Monitoring connected email accounts for recruiting-relevant signals
  • Sending emails and replies on your behalf when you authorize it
  • Generating briefings and activity summaries

Accounts and access

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account.

The Service supports multi-tenant organizations. Organization administrators can invite members, set roles, and manage access. Administrators are responsible for the actions of members they invite.

Your data

You retain ownership of all data you provide to or connect with the Service ("Your Data"). We process Your Data solely to provide and improve the Service, as described in our Privacy Policy.

You are responsible for ensuring you have the legal right to share candidate data, contact information, and any other personal data with the Service. If you process personal data of EU residents, you are the data controller and Opndig acts as a data processor on your behalf.

All actions taken in the Service are recorded in an immutable audit log. This log attributes every action to the actor who performed it (human user, AI agent, or system process) and cannot be altered or deleted.

Gmail integration

The Service offers optional Gmail integration that, when you connect it, allows Opndig to:

  • Read your emails to identify recruiting-relevant signals such as candidate replies, referral mentions, and hiring manager feedback
  • Send emails and replies on your behalf when you explicitly authorize the action or configure automated rules for specific scenarios (e.g., candidate follow-ups, check-ins)

By connecting your Gmail account, you grant Opndig permission to access your email data as described above. You understand that:

  • Emails sent by Opndig on your behalf are sent from your email address. You are responsible for their content and appropriateness.
  • You can review, edit, and approve emails before they are sent, or configure rules for automated sending. You can revoke automated sending at any time.
  • You can disconnect your Gmail account at any time, immediately stopping all access. You can also revoke access from your Google Account settings.

Opndig's use of Gmail data complies with the Google API Services User Data Policy, including the Limited Use requirements. See our Privacy Policy for full details.

AI-powered features

The Service uses AI models to generate candidate screenings, match scores, recommendations, and email drafts. You acknowledge that:

  • AI-generated outputs are decision-support tools, not hiring decisions. You are responsible for reviewing all AI outputs before acting on them.
  • AI outputs may contain inaccuracies, biases, or errors. The Service does not guarantee the accuracy, completeness, or suitability of any AI-generated content.
  • You are responsible for compliance with applicable employment and anti-discrimination laws when using AI-assisted screening in your hiring process.
  • When the AI agent sends emails on your behalf, you remain responsible for the content of those emails and their compliance with applicable laws (including CAN-SPAM, GDPR, and similar regulations).

Acceptable use

You agree not to use the Service to:

  • Violate any applicable law, including employment, anti-discrimination, data protection, and anti-spam laws
  • Send unsolicited bulk email, spam, or harassing messages through the Gmail integration
  • Discriminate against candidates based on protected characteristics
  • Upload or process data you do not have the legal right to use
  • Attempt to access data belonging to other organizations or users
  • Reverse-engineer, scrape, or extract AI model weights or training data through the Service
  • Misrepresent AI-generated content as human-authored in contexts where disclosure is required

We may suspend or terminate your account if you violate these terms, with notice where practical.

Billing and cancellation

Opndig is billed monthly at the current published rate. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months.

We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

Intellectual property

The Service, including its software, design, and documentation, is owned by Opndig and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

AI-generated content (screening assessments, email drafts, summaries) produced by the Service for your use belongs to you. We retain no ownership of outputs generated from Your Data.

Limitation of liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law:

  • We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
  • Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
  • We are not liable for hiring decisions made using AI-generated insights, or for emails sent on your behalf through the Gmail integration that you authorized.

Indemnification

You agree to indemnify and hold Opndig harmless from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, including candidate privacy rights, or (d) emails sent through the Service on your behalf.

Termination

Either party may terminate these Terms at any time. Upon termination:

  • Your access to the Service will be revoked
  • All connected integrations (Gmail, Slack) will be disconnected
  • You may request export of Your Data within 30 days
  • After 30 days, Your Data will be deleted except where retention is required by law

Changes to these Terms

We may update these Terms to reflect changes in the Service or for legal reasons. We will notify you by email or through the Service at least 30 days before material changes take effect. Continued use after changes constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Delaware.
